Lawyers request to expedite stay order over MP Faris detention
Appeal hearings concluded, no verdict
Order violates criminal procedures

Lawyers for Member of Parliament for Dhiggaru Constituency Ahmed Faris Maumoon has requested to expedite the stay order on his release.

The letter sent in by Lawyer Maumoon Hameed on Wednesday had expressed the defense’s concerns that the appeal, of the Criminal Court’s decision to detain him for the duration of investigation and trial, still was pending. High Court had concluded the hearings, but is yet to issue a verdict, the letter noted. The hearings were held on the 6th and the 9th of this month, with the Judge decreeing that the hearings had concluded. Sentencing was scheduled for the 20th, which was canceled afterwards.

Maumoon Hameed’s letter noted that the defense had put forward to nullify the indefinite remand, as it was issued on flawed legal grounds. The stay order, the letter said, was requested as MP Faris’ rights were compromised due to his indefinite detention.

It further noted that with High Court upholding verdict on Ahmed Shafiu, who was detained on similar charges of attempted bribery but released afterwards, created a precedent. This, the letter said, proved that MP Faris was detained on false grounds and against criminal procedures act.

When MP Faris was first arrested, the investigation into the bribery claims was ongoing. The formal charges were raised late in August.
