K-Park case: court orders to pay up over MVR 200,000, handover flat

The Civil Court has ordered Hanbo Company Private Limited to hand over the flat and pay up more than MVR 200,000, for violating an agreement made with a private party to buy a flat in K-Park Residences.

Hanbo had entered an agreement with Ali Bushry to sell an apartment at K-Park Residences.

According to the case filed at the court by the individual, the company has not handed over the apartment, which in turn violates Clause 12 of the agreement between him and the company, which mandated the company to complete the apartment and hand it over to him by July 2022.

According to the case lodged at the Civil Court, Bushry had sought compensation for the losses he attained after Hanbo failed to complete the apartment and hand it over to him within 30 days, as well as the expenses incurred to appoint lawyers due to the company’s failure to deliver on the agreement, on the date specified.

The individual sought compensation, in connection with the case, including the MVR 275,000 as compensation, MVR 25,000 per month until the apartment is completed as well as MVR 50,000 as expenses incurred to appoint legal representation to file the case at court.

In its order issued on Tuesday, the Civil Court instructed the company to complete the apartment and hand it over to its rightful owner within 30 days, as per the agreement, as well as to settle a fine of MVR 275,000 as compensation and MVR 25,000 per month until the apartment is completed.

MVR 12,000 is to be settled as expenses to hire an attorney.

Judge Mohamed Easa Fulhu presided over the hearing.

The accused had not filed defense even after being given a 14-day deadline.

The Maldives Police Service (MPS) raided the apartment of Hassan ‘Mandey’ Mamdhooh, who is facing several allegations of fraud, using forged documents under the name of Hanbo Maldives to sell apartments and embezzle money.

Mandey is the local shareholder of the company and has been slapped with 104 charges so far. Jaishan Saeed, who is also implicated in the case, faces 97 charges. The charges were filed at the Criminal Court on 12 December 2023.

The Prosecutor General’s Office (PG Office) revealed that the chargesheet includes charges in connection with the sale of a total of 23 apartments at K-Park Residences.

The 23 apartments were allegedly sold to more than 50 people, with more than six people to have bought a single apartment.

PG Office revealed that the further issues linked to the scheme are being investigated by the police institution, presently.
